This End User License Agreement ("EULA") regulates the extent and conditions to use applications of ZZZ Assault

PLEASE READ THIS END USER LICENCE AGREEMENT CAREFULLY.

By downloading or using the Application, you are agreeing to be bound by the terms and conditions of this Agreement, including all elements of the Application, including but not limited to the software and graphics included in the game (including components of the game licensed from third parties), and all updates and add-ons to the software, in-game-items and manuals. All rights, which are not explicitly granted to you by this EULA, remain at ZZZ Assault.

If you do not agree to the terms of this EULA, do not download or use the Application.

The use of this software is only allowed if you are above 18 years of age or if you are under 18 years of age with consent of your parent or guardian. A valid consent of the parent or guardian can only be granted if they were able to review and approve this EULA on your behalf.

1. License:

ZZZ Assault grants you a revocable, nonexclusive, nontransferable, limited license to download, install and use the Application solely for your personal, noncommercial purposes strictly in accordance with the terms of this Agreement.

It is explicitly forbidden,

• a) to copy, rent, sub-license, loan, modify, adapt, merge, translate, reverse engineer, decompile, disassemble the software of ZZZ Assault except as authorized by us in this EULA (or as permitted by law)
• b) to hack, distribute, transmit, harm, or misuse the software of ZZZ Assault.
• c) to commercially exploit the Application or make the Application available to any third party (i. e. Cyber Cafe, etc.).
• d) to use the software in any way not complying with applicable laws.

2. Patches, updates and changes:

We reserve the right to deploy or provide patches, updates, additional content or other modifications at any time. The EULA justifies no entitlement of such changes and also there is no right of dedicated software versions.

3. User generated content:

Depending on the Application you might have the opportunity to create user generated content ("Content").

You grant ZZZ Assault a non-exclusive, royalty-free, perpetual, irrevocable, worldwide right and license to make unrestricted use of your Content (including but not limited to broadcasting, displaying, modifying, adapting, publicizing, distributing or selling it) and agree that we have no obligation to notify you, pay you or ask permission to do so.

You declare and guarantee, that your Content is not violating applicable laws or rights of third parties. ZZZ Assault reserves the right to take steps against any individual or group who creates or distributes Content violating the EULA.

If you become aware of Content violating your rights or rights of any Third Party, please notify us.

4. Video policy:

ZZZ Assault allows you to create videos of Applications and publish these on your website, YouTube or similar video sharing websites such as Twitch on the following conditions:

• a) You may not take assets (such as graphics, voice, music or other items) and publish or distribute these separately.
• b) Except (c), any Videos must be non-commercial and you may not sell or license Videos to others for payment.
• c) You may monetize Videos you have created through the YouTube partner program or other similar programs and video sharing websites.
• d) We retain the exclusive right to give you notice in writing (including email) requiring you to remove any Video you have created from any website.

5. Term and Termination:

This Agreement shall remain in effect until terminated by you or ZZZ Assault.

This Agreement will terminate immediately, without prior notice from ZZZ Assault, in the event that you fail to comply with any provision of this Agreement.

You may also terminate this Agreement by deleting the Application and all copies thereof from your mobile device or from your desktop.

Upon termination of this Agreement, you shall cease all use of the Application and delete all copies of the Application from your mobile device or from your desktop.

6. Limited scope of service:

We make no warranties in any way regarding whether the Software is of satisfactory quality and in all terms, uninterrupted, unlimited, error free be available. In principle, you have also no entitlement about existing features, content or other parts of the software.

7. Limitation of liability:

Our liability in relation to the Software is except in cases for death or personal injury limited to intent and gross negligence.

8. Amendments to this Agreement:

ZZZ Assault reserves the right, at its sole discretion, to modify or replace this EULA at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. With your continued use of the software after the changes have come into effect, you agree to the changes and are legally bound to them.

9. Severability:

If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

10. Governing law:

This EULA shall be governed by and interpreted according to the laws of Germany and that any dispute regarding this EULA shall be heard exclusively by the courts of Germany.
